These Terms of Use govern your access to and use of the website operated by American Coastal Insurance Company (“AmCoastal,” “we,” or “us”) at amcoastal.com and any subdomains or successor URLs (the “Site”). By accessing the Site, you agree to be bound by these terms. If you do not agree, do not use the Site.
1. Who we are
American Coastal Insurance Company is a Florida-domiciled property and casualty insurer licensed to write commercial residential property in Florida. We are a wholly owned subsidiary of American Coastal Insurance Corporation (Nasdaq: ACIC), headquartered at 570 Carillon Parkway, Suite 100, St. Petersburg, FL 33716.
The Site is a marketing and informational resource for the carrier. It is not a policy portal, a claims system, or a policyholder service center. Policy-specific questions should go to the managing general agent that wrote your coverage: AmRisc Group for condominium and homeowner association business, or Skyway Underwriters for apartment and assisted living business.
2. Permitted use
You may use the Site for lawful, personal, and informational purposes only. You may not: scrape, crawl, or harvest content or data from the Site by automated means; use the Site to transmit spam or unsolicited commercial communications; attempt to probe, scan, or test the vulnerability of the Site or any connected system; or use the Site in any way that violates applicable law.
We grant you a limited, non-exclusive, non-transferable license to access and view the Site's publicly available content for personal, non-commercial use. This license does not include the right to copy, reproduce, distribute, modify, or create derivative works from any content on the Site without our prior written consent.
3. No coverage or advice created
Nothing on the Site constitutes an offer to issue insurance coverage, a binder, an endorsement, or a modification to any existing policy. Coverage is subject to the terms, conditions, exclusions, and limits of each individual policy contract as issued.
The Site does not provide legal, tax, financial, or insurance advice. Content describing our products, reinsurance program, or financial ratings is informational only. Consult your licensed insurance professional for advice specific to your situation.
4. Intellectual property
All content on the Site, including the AmCoastal name, Compass Rose mark, text, graphics, photographs, data, software, and the selection and arrangement of content, is owned by or licensed to AmCoastal and is protected by United States copyright, trademark, and other intellectual property laws.
The AmCoastal name and Compass Rose design are service marks of American Coastal Insurance Company. Nothing on the Site grants you any right or license to use our marks without prior written permission.
5. Third-party links
The Site contains links to websites operated by AmRisc Group, Skyway Underwriters, Demotech, KBRA, the Florida Hurricane Catastrophe Fund, and other third parties. These links are provided for your convenience. We do not control those websites, do not endorse their content, and are not responsible for their privacy practices or terms of use.
Your use of any third-party website is subject to that site's own terms and conditions.
6. Disclaimer of warranties
THE SITE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT.
We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or timeliness of any content on the Site. Financial strength ratings, product availability, and other information are subject to change without notice.
7. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, AMCOASTAL AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE SITE OR ANY CONTENT ON THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Our total liability to you for any claim arising out of or related to the Site, whether in contract, tort, or otherwise, shall not exceed one hundred dollars ($100).
8. Governing law and venue
These Terms of Use are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict-of-laws principles.
Any dispute arising out of or related to the Site or these Terms shall be brought exclusively in the state or federal courts located in Pinellas County, Florida. You consent to the personal jurisdiction of those courts and waive any objection to venue in Pinellas County.
9. Changes to these terms
We may update these Terms of Use at any time. When we do, we will post the revised terms with a new effective date. Your continued use of the Site after any update constitutes acceptance of the revised terms.
Material changes will be noted at the top of this page for at least 30 days after the effective date.
