Privacy Notice

We collect personal information needed to evaluate applications, underwrite and price policies, administer coverage, adjust claims, and meet legal and regulatory obligations. Sources include the applications and forms you submit through your appointed agent, claims documentation, public records, consumer reporting agencies, prior carriers, and authorized service providers.

Categories may include: name, mailing address, contact information, date of birth, Social Security number, government identifiers, property address, building characteristics, loss history, payment information, claim details, and information about household members or associated parties when relevant to underwriting.

On this website we also collect limited technical information through your browser, including IP address, device type, browser type, referrer, pages viewed, and timestamps. Use of analytics or marketing technologies, if any, depends on your cookie preferences (see Section 6).

We use personal information to: evaluate applications and underwrite policies; price, issue, and service coverage; adjust and pay claims; communicate with policyholders and producers; prevent fraud; comply with legal, regulatory, and reinsurance reporting requirements; and operate our business.

We do not use personal information for purposes that are materially different from those listed in this notice without providing notice and, where required by law, obtaining consent.

As a financial institution, AmCoastal is subject to the GLBA Privacy Rule (15 USC § 6801 et seq.) and applicable state insurance privacy regulations including the NAIC Insurance Information and Privacy Protection Model Act framework.

We do not disclose nonpublic personal financial information about our customers or former customers to nonaffiliated third parties except as permitted by law (for example, to service providers acting on our behalf, to reinsurers, to regulators, in response to legal process, or to detect and prevent fraud). Disclosures to affiliates are made consistent with applicable law.

Producers, agents, and managing general agents (AmRisc Group and Skyway Underwriters) act on our behalf in distribution and claims and are subject to confidentiality obligations.

We may share personal information with: our managing general agents and appointed producers; reinsurers, including the Florida Hurricane Catastrophe Fund and authorized commercial reinsurers; service providers that perform claims handling, fraud prevention, IT, mailing, payment processing, and similar functions; affiliates within the American Coastal Insurance Corporation corporate group; regulators including the Florida Office of Insurance Regulation; law-enforcement authorities and courts pursuant to legal process; and parties in connection with a sale, merger, or reorganization of part or all of our business.

We do not sell personal information for monetary consideration. As discussed in Section 7, we do not share personal information for cross-context behavioral advertising as those terms are defined under the CCPA/CPRA.

We maintain physical, electronic, and procedural safeguards reasonably designed to protect personal information against unauthorized access, alteration, disclosure, or destruction. Access is limited to employees, agents, and service providers with a business need.

No method of transmission or storage is perfectly secure. If we become aware of a breach of unencrypted personal information, we will notify affected individuals and regulators in accordance with applicable federal and state law.

Information collected in the course of underwriting and claims handling is governed by GLBA and state insurance privacy regulations, which the CCPA exempts from many of its requirements. Other information collected through this website is covered by the CCPA/CPRA rights described above.

The Florida Digital Bill of Rights (Fla. Stat. § 501.701 et seq.), effective July 1, 2024, gives Florida consumers rights with respect to personal information processed by controllers that meet the statutory threshold. To the extent the FDBR applies to processing by AmCoastal that is not preempted by GLBA, you may have the right to: confirm whether we are processing your personal data and access that data; correct inaccuracies; request deletion; obtain a portable copy; opt out of targeted advertising, the sale of personal data, and certain profiling; and opt out of the collection or processing of sensitive data.

To exercise FDBR rights, contact us using the channels in Section 11. We will respond within the timeframes the statute requires.

This site is directed to insurance professionals, association boards, claimants, and investors. It is not directed to children under the age of 13, and we do not knowingly collect personal information from children under 13. If we learn that personal information of a child under 13 has been collected through this site, we will delete it. If you believe a child has provided personal information to us, please contact us using the channels in Section 11.

We retain personal information for the period required to fulfill the purposes for which it was collected and to satisfy legal, regulatory, accounting, reinsurance, and litigation-hold obligations. Insurance records are subject to retention requirements set by Florida law and our internal records-retention schedule, which generally require multi-year retention after policy expiration or claim closure.
